1. changes to this privacy policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. When we make changes, we will post the revised Privacy Policy on the Site, update the “Last updated” date, and take any other steps required by applicable law.

2. how we collect and use personal information

To provide and improve the Services, we collect— and in the past 12 months have collected—personal information about you from various sources. The information we collect depends on how you interact with us. In addition to the specific uses below, we may use information to communicate with you, provide or improve the Services, comply with legal obligations, enforce our Terms of Service, and protect the Services, our rights, and the rights of users or others.

3. information we collect directly from you

  • Contact details (name, address, phone number, email).
  • Order details (name, billing/shipping address, payment confirmation, email, phone).
  • Account details (username, password, security questions, other information used for account security).
  • Customer support content (information you include when contacting us).
  •

Some features may require you to provide certain information. You can choose not to provide it, but certain features may not function.

4. information we collect about your usage

We automatically collect certain information about your interaction with the Services (“Usage Data”) using cookies, pixels, and similar technologies (“Cookies”). Usage Data may include: device and browser information, network connection details, IP address, clickstream data, and information about how you use the Site and your account.

5. information we obtain from third parties

We may receive information about you from third parties, including vendors and service providers who collect information for us, such as:

  • Shopify and its related services that power our store.
  • Payment processors (e.g., card/bank information tokens, billing address) to process payments and fulfill orders.
  • Advertising/analytics partners (e.g., Google Analytics, Meta, TikTok) via pixels, SDKs, third-party libraries, and Cookies when you visit the Site, open our emails, or interact with our ads.

Any information we obtain from third parties will be processed according to this Privacy Policy. See also Third Party Websites and Links below.

6. how we use your personal information

  • Providing products and Services. To process payments; fulfill orders; send notifications about accounts, purchases, returns, exchanges, or other transactions; create and manage accounts; arrange shipping and returns; and provide related features. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services you choose to use (Shopify will process your information per its Privacy Policy and Consumer Privacy Policy).
  • Marketing and advertising. To send marketing/promotional communications by email, SMS, or postal mail and to show you ads for products or services, including tailoring ads on our Site and other websites.
  • Security and fraud prevention. To detect, investigate, and act on possible fraud, illegal activity, or security incidents. If you have an account, you are responsible for safeguarding your credentials. Contact us immediately if you believe your account is compromised.
  • Communicating with you and service improvement. To provide customer support, respond to inquiries, and operate, improve, and optimize the Services.
  • Legal compliance. To comply with legal, tax, and audit obligations and to enforce our Terms.

7. cookies

We use Cookies to operate and improve the Services (e.g., remember preferences), run analytics, and better understand interactions. For cookies related to Shopify, see https://www.shopify.com/legal/cookies.

Most browsers accept Cookies by default. You can remove or reject Cookies in your browser settings. Blocking Cookies may affect your experience and some features may not function. Blocking Cookies may not fully prevent information sharing with third parties (e.g., advertising partners).

Global Privacy Control (GPC). Our website recognizes the GPC signal. If you enable GPC, we treat it as a valid opt-out of sharing/targeted advertising for that browser or device and, if we can associate the device with a Shopify account, we will apply it to the account as well. Other than GPC, we do not respond to “Do Not Track” signals.

We may also use third-party analytics and advertising cookies such as Google Analytics and TikTok Pixel to better understand usage and improve our marketing.

8. how we disclose personal information

We may disclose personal information in the following circumstances (subject to this Policy):

  • Vendors/service providers performing services for us (IT, payment processing, analytics, customer support, cloud storage, fulfillment and shipping).

  • At your direction/with consent (e.g., shipping partners; social media widgets; login integrations).
  • Affiliates within our corporate group.
  • Business transactions (e.g., merger, acquisition, reorganization, bankruptcy).
  • Legal and rights protection (comply with subpoenas/warrants; enforce terms; protect the Services, our rights, and users’ rights).

If you wish to exercise this right, you can contact us directly at [support@zyavie.com] with your request.

If we transfer personal information out of Europe/UK, we rely on recognized transfer mechanisms such as the EU Standard Contractual Clauses and/or UK IDTA/Addendum, unless the destination country provides an adequate level of protection.

Our Site may link to third-party websites or platforms. We are not responsible for the privacy/security of such sites or the accuracy/completeness of information found there.
